Lodger Eviction Notice – Breach Of Agreement

If you have a lodger in your home and they have breached the terms of the lodger agreement (other than non-payment of rent), you can serve the notice below.

The usual notice period for lodger’s is 28 days, and if your lodger is not in a serious breach of the agreement, you should stick to that. Also, if you haven’t done so already, it might be a good idea to talk to your lodger before serving them an eviction notice, because there might be a reasonable explanation for the minor breach, and there could also be a solution to suit both parties.

However, for more serious issues – where redemption is out the window – such as stealing, or violent behaviour, a shorter notice period may be appropriate.

Dear [Lodger name],

You currently have an excluded lodger agreement with me because you share accommodation with me in my home.

However, currently you are in breach of the lodger agreement because [insert details of breach].

I therefore give you notice that I require you to vacate the room, facilities you share with me and my home on or before [insert date ideally 28 days from now but can be 14 days if the circumstances are appropriate. This date must be “reasonable”].

Please note: as you are a lodger in my home, if you fail to vacate on or before the date given above, I do not require a court order to enforce this notice because you are excluded from that requirement (see section 3A Protection from Eviction Act 1977 available at http://www.legislation.gov.uk).

Any personal belongings that remain in my home after the date mentioned above will be treated as abandoned and disposed of, the costs of which will be payable by you.
